‘The hospital never told us:’ Cincinnati Children’s loses $2 million spine surgery lawsuit
Cincinnati Children’s Hospital Medical Center was ordered to pay $2 million for its role in an unnecessary surgery at its facilities performed by a now-fugitive surgeon, according to the plaintiff’s mother, Melissa Morgan of Middletown.
Dr. Abubaker Atiq Durrani was an area spine surgeon accused of lying about his medical schooling to get licensed in the state. Over a course of years, he performed unneeded and at times botched procedures. He was arrested in 2013 on federal criminal charges including fraud and fled the country later that year.
Two days before the ruling, more than 550 people together filed a federal lawsuit against the Ohio Medical Board alleging the oversight agency failed to properly vet Durrani and then ignored concerns raised by his colleagues.
The suit says Durrani claimed on his application for an Ohio medical license that he attended Bolan Medical College, which he didn’t. He also falsely claimed he graduated from Army Medical College in his native Pakistan, the suit claims.
Durrani was licensed by the board in 2004 and began working at Cincinnati Children’s in 2006. Durrani’s Center for Advanced Spine Technologies had offices in Evendale and Florence.
The suit also includes a 2009 letter from three area doctors raising “significant concerns” about Durrani’s surgical decisions.
The physicians wrote that Durrani was performing “unnecessary … and fraudulent surgeries,” the suit claims, but the board did not act on the letter.
“The physicians were in a state of disbelief that (the board) … did nothing to investigate or otherwise protect the public from Durrani,” the suit says.
The board did not immediately return a request for comment Saturday.
